What Is Covered

Fortuitous accidental damage, meaning unforeseen, despite reasonable precautions being taken to:

  • The contract works (the structure being built)
  • The materials being used (e.g. bricks)
  • Labour costs incurred to add value to the works
  • Free issue materials (materials provided by the owner)
  • Temporary works (e.g. temporary roads, scaffolding etc)

Perils Covered

  • Elements of nature (e.g. storm, wind, earthquake, subsidence, collapse)
  • Fire
  • Theft
  • Electrical/Mechanical failure during testing
  • Damage resulting from prior defects in materials or workmanship
  • Transit and Temporary Storage within Territorial Limits
  • Equipment returned to manufacturer for modifications

What Is Not Covered

  • Non fortuitous events
  • Negligent acts (better covered under PI)
  • Damage caused by manufacturing processes and misapplication of tools

Own Surrounding Property

  • Property not forming part of the contract works
  • But performance of the contract requires work to be performed on the property
  • ‘Contractually in the custody and control of the contractor – for work thereon’
  • Damage must arise directly from the work carried out in the terms of the contract

Public Liability (Section II)

  • Covers legal liability for loss or damage to third party property or persons
  • Arising out of the performance of the contract

Removal of Support (Section III)

  • Extends liability cover to include cover for removal of support
  • Geotechnical report or details of method of construction required prior to granting cover
